These General Terms and Conditions apply to all services provided by Davidson International Group B.V. ("Davidson", "we", "us") including freight forwarding, customs clearance, road transport, ocean freight, air freight, warehousing, and logistics consulting. By engaging our services, the client accepts these terms in full.
All our services are performed under the Dutch Forwarding Conditions (Nederlandse Expeditievoorwaarden), filed by FENEX with the District Court of Amsterdam and Rotterdam. A copy is available at www.fenex.nl.
Davidson acts as a freight forwarder and logistics agent. Unless explicitly agreed otherwise in writing, Davidson acts as agent on behalf of the client and not as principal carrier.
The client is responsible for providing accurate, complete and timely instructions and documentation. Davidson cannot be held liable for any loss, delay, costs or penalties arising from inaccurate or incomplete information provided by the client.
Carrier liability for loss or damage to goods in transit is strictly limited under applicable international conventions. Davidson strongly recommends that clients arrange adequate cargo insurance through their own broker. Unless expressly requested in writing, no insurance is arranged by Davidson on the client's behalf.
Customs clearance is carried out based on information provided by the client. Duties, taxes, VAT and other government-imposed charges are excluded from our fees unless explicitly stated.
Davidson cannot be held liable for failure to perform caused by circumstances beyond our reasonable control, including acts of war, natural disasters, strikes, government restrictions, or carrier schedule changes.
Invoices are payable within 14 days of invoice date unless otherwise stated. All amounts are in EUR unless otherwise specified.
Davidson has a right of retention over all goods, documents and funds in its possession in respect of any outstanding amounts owed by the client.
These terms are governed by Dutch law. Any disputes shall be submitted to the competent court in Rotterdam, the Netherlands.
